Frequently Asked Questions
Q: If I have only one or two drinks, can I be convicted of drunk driving? A: If the state can prove that your blood alcohol content was 0.08 or greater when you were pulled over, you can be convicted of drunk driving, regardless of how much alcohol you drank. However, you could be convicted of drunk driving even if you did not take a breathalyzer test. The prosecutor could bring in a police officer to describe the impaired driving that led him to pull you over, as well as your inability to perform on sobriety tests. If the court or the jury believes the officer and finds that the prosecutor has proved his/her case beyond reasonable doubt, you could be convicted of drunk driving.
Q: What type of punishment might I be given if I’m found guilty of driving under the influence? A: Depending upon whether this is your first offense or a subsequent offense, your license may be suspended for thirty (30) days up to two years. Also depending upon the circumstances, your license could be revoked. You will likely have to attend alcohol education and treatment classes. Other possible penalties include vehicle confiscation, the application of an ignition interlock device, jail time, fines, and community service. Typically, first-time offenders incur a fine, and jail time is possible. Repeat DUI offenders will receive harsher fines, and will likely be sentenced to jail time. Penalties will be even harsher if you were involved in an accident in which someone was injured or killed. |
Getting pulled over after having a few drinks does not indicate automatic legal guilt.
We know the devastating effects a DUI (Driving Under the Influence a.k.a. "drunk driving") conviction can have on a person's work, home, and social life. The minimum license suspension is thirty days. One month can seem like an eternity without your driving freedom. Additionally, a DUI arrest could result in a misdemeanor, or possible even a felony charge on your record.
A test that indicates a high blood alcohol content (BAC) does not automatically convict you of drunk driving. The accuracy of your breath test, the interpretation of your blood test, and the field sobriety test will contribute to the legality of a DUI. Having the representation of Wantland Law will provide the knowledge and determination that is crucial to a successful case.
A drunk driving conviction can remain on your record indefinitely for employers and others to see unless you do something to have the record removed.
